Terms of Service & License

These terms are an agreement between you and GSMFABRICA CO LIMITED, a company registered in Hong Kong ("HydraDesk", "we", "us"). They govern your use of the HydraDesk remote-support service at hydradesk.org and the HydraDesk Support client software. By downloading, running, or using HydraDesk, you agree to these terms. If you do not agree, do not use the service.
1. The software and its licence
The HydraDesk Support client is based on the open-source RustDesk project and is free and open-source software licensed under the GNU Affero General Public License, version 3 (AGPL-3.0). Nothing in these terms limits the rights the AGPL-3.0 grants you in that software. These terms instead govern your use of the hosted service we operate (the rendezvous and relay servers and this website).
2. Licence to use the service
We grant you a limited, non-exclusive, revocable right to use the HydraDesk service to give or receive remote technical support, subject to these terms.
3. Acceptable use
- Only start or accept a remote session where you own the device or have the explicit, informed consent of the person who controls it.
- Do not use the service for any unlawful, fraudulent, harmful, or abusive purpose.
- Do not use HydraDesk to access, monitor, or control a device without the user's knowledge and consent.
- Do not attempt to disrupt, overload, reverse-engineer the service infrastructure, or circumvent its security.
4. Remote access and consent
A support session lets an agent view and control the remote device. The person being supported must consent before a session begins and can end it at any time by closing the app. Agents must act only within the scope the user has authorised and only for the purpose of providing support.
5. No warranty
The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that the service will be uninterrupted, secure, or error-free.
6. Limitation of liability
To the maximum extent permitted by law, HydraDesk will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, profits, or business, arising from your use of the service or from any remote session conducted between users. You are responsible for the actions taken during sessions you initiate or accept.
7. Suspension and termination
We may suspend or terminate access to the service, in whole or in part, if you breach these terms or where necessary to protect the service or its users.
8. Governing law
These terms are governed by the laws of Hong Kong, without regard to conflict-of-laws rules.
9. Changes
We may update these terms from time to time. Continued use of the service after a change means you accept the updated terms. The "last updated" date above reflects the current version.
